Legal Framework: Law No. 30 of 2000 (Trade Secrets), Law No. 28 of 2014 (Copyright), and Articles 1338 & 1365 of the Indonesian Civil Code (KUH Perdata). By participating in any workshop hosted by PT Seni Puspa Bali, the Attendee acknowledges and agrees to the following: Trade Secret Protection (Law No. 30/2000): The Attendee acknowledges that the chemical ratios of incense, wax-to-fragrance mixtures, and proprietary instructional methodologies are "Trade Secrets." Under Article 11 of Law No. 30/2000, any person who deliberately reveals or uses these secrets without consent is liable for criminal and civil penalties. Copyright Ownership (Law No. 28/2014): All curriculum content, historical narratives, and instructional scripts are protected under Article 40 of Law No. 28/2014. PT Seni Puspa Bali retains exclusive "Moral Rights" and "Economic Rights" over these works. Non-Replication & Anti-Proxy: In accordance with Article 1338 of the Civil Code (Pacta Sunt Servanda), this agreement is legally binding as law between the parties. The Attendee, their employer, business partners, or immediate family members are strictly prohibited from replicating this business model or teaching similar content for three (3) years within Bali. Non-Solicitation: To protect the stability of the business, the Attendee agrees not to solicit, hire, or engage any employee or contractor of PT Seni Puspa Bali for a period of 24 months. Commercial Media Restriction: Recording for the purpose of creating competing digital products is a violation of the Copyright Law. Footage is for Personal, Non-Commercial use only. Liquidated Damages & Tort (Article 1365): The Attendee agrees that any breach constitutes an "Unlawful Act" (Onrechtmatige Daad) under Article 1365 of the Civil Code. The Attendee agrees to pay a fixed sum of IDR 300,000,000.00 (Three Hundred Million Rupiah) as liquidated damages to compensate for the loss of trade secret exclusivity and brand dilution.
